MED/ARB is a process that combines Mediation with Arbitration. In Med/ARB first a neutral third-party Mediator helps the parties communicate in an effort to work out solutions to their conflict. If a resolution is not reached, the parties can mutually agree to go to Arbitration (with the same or a different person) and the Arbitrator makes a decision that is binding. MED/ARB allows the parties an opportunity to exercise self-determination during the Mediation phase, and if Mediation is not successful, to have finality in the Arbitration phase.
